Terms of Use
These Terms of Use ("Terms") govern your access to and use of the SyncFlow application and related services operated by Yoshifumi Kanno ("I", "me", or "my"). By downloading, accessing, or using the Service, you agree to these Terms.
1. Service Description
SyncFlow is a software tool intended to help users synchronize selected data between Fitbit and Apple Health. The Service may also include settings, ads, analytics, purchase infrastructure, and support features.
2. Eligibility
You must be legally capable of entering into these Terms and must comply with the laws applicable to you. If you use the Service on behalf of another person or entity, you represent that you have authority to do so.
3. Acceptable Use
You agree not to:
- use the Service in violation of any law, regulation, platform rule, or third-party terms;
- interfere with the Service, its integrations, or related infrastructure;
- attempt to reverse engineer, abuse, scrape, or misuse the Service except as permitted by law;
- use the Service in a way that risks harm to others or to third-party platforms.
4. Third-Party Accounts and Services
The Service depends on third-party services and platforms, including Fitbit, Apple Health, AdMob, Firebase, Sentry, and RevenueCat. I do not control those third parties. Their availability, rules, APIs, permissions, data handling, pricing, and account decisions may affect the Service at any time.
5. No Medical Advice or Emergency Use
The Service is not a medical device, not medical advice, and not intended for diagnosis, treatment, or emergency use. Do not rely on the Service for urgent, clinical, or life-critical decisions.
6. No Guarantee of Sync Results
I do not guarantee that any sync will be accurate, complete, current, uninterrupted, or available at all times. Data may be delayed, duplicated, omitted, reformatted, rejected, changed by platforms, or affected by permissions, device state, operating system behavior, platform APIs, or third-party outages.
7. Your Responsibilities
You are responsible for:
- reviewing your synced data and deciding whether it is suitable for your personal use;
- maintaining access to your devices, accounts, permissions, and internet connectivity;
- maintaining your own backups or records where accuracy or retention matters to you;
- complying with Fitbit, Apple, Google, and other applicable third-party terms.
8. Ads, Purchases, and Subscriptions
The Service may display ads and may offer purchases or subscriptions. Ad delivery, consent handling, billing, renewals, and platform charges may be handled by third-party providers. Additional platform terms may apply.
9. Suspension, Changes, and Termination
I may change, suspend, limit, or discontinue any part of the Service at any time, with or without notice, to the maximum extent permitted by law. I may also suspend or terminate access where reasonably necessary for legal, security, abuse-prevention, operational, or platform-compliance reasons.
10. Disclaimer of Warranties
To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis, without warranties of any kind, express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, or reliability.
11. Limitation of Liability
To the maximum extent permitted by law, I will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, health records, goodwill, revenue, profits, opportunity, or business interruption arising out of or related to the Service.
To the maximum extent permitted by law, my total aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the amount you paid to me for the Service in the 12 months before the event giving rise to the claim, or (b) JPY 10,000.
12. Indemnity
To the maximum extent permitted by law, you agree to defend, indemnify, and hold me harmless from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of the Service, your violation of these Terms, or your violation of applicable law or third-party rights.
13. Privacy
Your use of the Service is also subject to the Privacy Policy.
14. Governing Law and Venue
These Terms are governed by the laws of Japan, without regard to conflict of laws principles. To the maximum extent permitted by law, the Tokyo District Court or the Tokyo Summary Court, as applicable, will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service.
If the laws of your jurisdiction give you non-waivable consumer, privacy, or other rights, or require another court or law to apply to some matters, those rights and rules apply only to the extent they cannot lawfully be excluded.
15. Changes to These Terms
I may update these Terms from time to time. Continued use of the Service after updated Terms become effective means you accept the updated Terms, to the extent permitted by law.
